The United States Court of Appeals for the Fifth Circuit recently affirmed a dismissal of the Plaintiff’s claims in favor of firm client Lowe’s Home Centers, L.L.C. in a negligence lawsuit where the Plaintiff alleged that he was injured while shopping at our client’s store. The United States District Court for the Western District of Texas (El Paso Division) granted our client’s motion to dismiss the Plaintiff’s claims and the Fifth Circuit affirmed. Our client was represented in the trial court by partners Zach T. Mayer and Brian J. Fisher, and in the appellate court by partner Kevin J. Keith and associate Andrew J. Upton.
