Mayer Provides Strategic Defense Through Years of Complex, Multi-Party Litigation

Mayer recently secured a highly favorable outcome for a Texas construction contractor following seven years of litigation stemming from a major explosion at a construction site. Over the course of this multi-year litigation, Aaron Speer and Brandon Maxey, with support from Ross Kepesky, successfully defended the contractor against high-value personal-injury and wrongful-death lawsuits, as well as claims for lost business and other damages asserted by the site’s owner.

The team also defended against indemnity and contribution claims brought by co-defendants, while simultaneously leveraging similar claims on behalf of the contractor against other parties. The case involved dozens of plaintiffs and defendants and more than 50 depositions over five years, ultimately resolving through confidential settlements that were favorable to the client.

In September of this year, Wade McClure and Brandon Maxey secured an additional key victory in a related arbitration involving the project’s general contractor. After a three-day hearing and substantial post-hearing briefing, the arbitration panel awarded the client more than $430,000 for work performed prior to the incident despite counterclaims seeking offsets and indemnification under the governing contract.

This combination of coordinated defense efforts, carefully managed litigation, and a decisive arbitration result not only protected the client from hundreds of millions in potential exposure but also enabled them to recover funds owed for their work. Reaching such a positive resolution after years of hard-fought, multi-party litigation reflects the depth of Mayer’s experience in navigating complex disputes from every angle.
