Mayer Construction Defect Team Secures Complete Summary Judgment in 12-Party Lawsuit
Mayer Construction Defect partner Nader Arbabi and attorneys Chaz Lidia and Abigail Raney secured complete summary judgment on behalf of a general contractor client in a high-value, 12-party construction defect lawsuit.
The plaintiffs asserted seven-figure claims arising from the underlying construction project. Through a detailed investigation of the project history and development of the evidentiary record, the Mayer team demonstrated that the claims were barred by the applicable statute of limitations and that the discovery rule did not extend the limitations period.
The team’s motion challenged every cause of action asserted against the client, combining the dispositive limitations argument with independent contractual, economic-loss, warranty, and no-evidence grounds. The court granted the motion in full, eliminating all claims against our client without the need for trial.
Because the plaintiffs’ claims formed the basis of the broader multi-party dispute, the ruling ultimately brought the 12-party litigation to a close.
Nader, Chaz, and Abigail were supported throughout the matter by Jill Britt and Karen Moseley. The team’s early development of the factual record and focus on dispositive issues positioned the matter for resolution without the time and expense of trial.
