Efrain Forté III was born in Chicago, Illinois and grew up in Tampa, Florida. He received his undergraduate degree from the University of Central Florida. He then attended the University of Arkansas School of Law in Fayetteville, Arkansas where he learned valuable trial experience working as a student attorney at the Washington County Prosecutor’s office.

Efrain is a civil litigation defense trial attorney who represents individuals and companies involved in complex high exposure loss actions throughout Texas and Arkansas, with his focus being primarily in the Dallas/Fort Worth area. Prior to joining Mayer LLP Efrain gained trial experience representing fortune 500 companies and individuals in cases involving high-risk commercial transportation, automobile, wrongful death, oil & gas, and premises liability litigation resulting in favorable resolutions for his clients.

As a student Efrain knew that he wanted to become a litigator and focused on the litigation practice area. His courtroom experience began when he served as a student attorney representing indigent clients in the University of Arkansas School of Law’s Legal Clinics. Additionally, Efrain was a judicial extern for the Honorable Judge Mark Lindsay of the Fourth Judicial Circuit in Washington County, Arkansas.

Efrain has developed a particular ability in quickly and accurately evaluating lawsuits and other high exposure risks for his clients. He concentrates on implementing creative and aggressive strategies to change the dynamics of a case, and to obtain the best possible result in mediation, arbitration, or trial. Efrain’s extensive business minded litigation experience and creative approach to litigation also provides a solid foundation for him to counsel clients on the resolution of disputes through alternative mechanisms such as strategic motion practice and early settlements.

When not in the courtroom Efrain’s personal interests include deep sea fishing, hunting, college football, travelling, cooking, and spending time with his family.

Representative Experience

Obtained final summary judgment in favor of a national trucking client, in a nonsubscriber wrongful death and survival action lawsuit that was pending in the United States District Court for the Southern District of Texas. Plaintiffs asserted a multimillion-dollar wrongful death and survival action against a trucking client, alleging that the decedent driver was an employee of the trucking company, at the time of the accident, and that the trucking company’s negligence proximately caused the death. In a lengthy 19-page opinion, the Federal Court granted final summary judgment in favor of the national trucking company.

Unanimous jury defense verdict on behalf of property owner involved in highly contested multimillion-dollar vehicle intrusion case in Bowie County, Texas. Plaintiff argued that the property owner was negligent and grossly negligent for not implementing “anti-intrusion” systems to prevent vehicles from running into the storefront. After a four-day trial the jury rejected Plaintiff’s arguments and returned a unanimous defense verdict, in less than an hour, in favor of the property owner.

Settlement in favor of national trucking client in a wrongful death and survival case in which Plaintiffs were represented by one of the top trial firms in Texas. Settled on eve of trial for same amount that was rejected by Plaintiffs earlier in the case.
