Mayer Wins Cross-Verdicts in Breach of Fiduciary Duty & Tortious Interference Case

Mayer secured a significant 12-0 cross-verdict victory in a complex business dispute involving claims of breach of fiduciary duty, tortious interference and usurpation of corporate opportunities. Attorneys Robert Smith and Raymond Johnson skillfully defended the Defendants, a home health business, hospice business, and their owner, against claims from the Plaintiff related to their former business partnership.

The dispute arose from a home health and hospice venture in which the Defendant had made a substantial investment. The Plaintiff, who handled day-to-day operations, accused the Defendant of breaching fiduciary duties. However, evidence presented at trial showed that the Plaintiff had repeatedly withdrawn large sums of money from the business without adequate documentation, resulting in tax liabilities for the Defendant and financial instability for the business.

After the Plaintiff filed suit, the Defendant counterclaimed, asserting that the Plaintiff herself had breached the terms of the partnership agreement and her fiduciary duties.
