Mayer Secures Unanimous Verdict for Physician in Medical Battery & Informed Consent Case

Mayer secured a 12-0 defense verdict in a complex medical malpractice case led by Robert Smith and Raymond Johnson. Our client, a physician specializing in hematology, oncology and geriatric medicine, was falsely accused of medical battery and failure to obtain informed consent.

The case centered around the treatment of an elderly patient with severe underlying health conditions, including heart failure, kidney failure, and a critically elevated white blood cell count that was later identified to be the result of two types of Leukemia.

Our client prescribed a highly specialized medication, hydroxyurea, to manage the patient's condition, which the Plaintiff's family alleged caused the patient's deterioration.

Through meticulous legal analysis and a strong defense strategy, our team successfully refuted the Plaintiff's claims, demonstrating that the physician's treatment was consistent with the standard of care and did not contribute to the patient’s decline, as evidenced by improving lab values. Additionally, testimony from experts confirmed that no specific written consent was required for the administration of this treatment.

After thorough deliberation, the jury unanimously found that our client had fully met the standard of care, leading to a no-liability verdict.

Our team's deep understanding of the medical and legal principles allowed us to effectively navigate the complexities of this case and secure a unanimous verdict, which vindicated our client’s professional care and dedication to his patients.
